Jurats

A jurat is used when the signer is swearing to the content of the document. The notary must administer an oath or affirmation to the signer in order to complete the jurat. A jurat also requires that the signer signs in the presence of the notary. It is possible to glean this information from the jurat certificate itself. The wording states “Subscribed and sworn to before me…” – subscribed meaning “signed” and sworn meaning that an oral oath or affirmation was given. “Before me” means that both were done in the presence of the notary public.

 

Acknowledgements

An acknowledgement is used to verify the identity of the signer and to confirm that they signed the document. They are not swearing to the truthfulness or validity of the document, they are simply acknowledging that they signed the document.

 

Oaths/ Affirmations

While both oaths and affirmations are notarial acts that compel a person to tell the truth, an oath is a solemn, spoken pledge to God or a Supreme Being, while an affirmation is a spoken pledge made on the signer’s personal honor with no reference to a higher power. Either is considered acceptable, and the choice is left to the signer.

 

 

Copy Certifications

A copy certification is a notarial act in which the notary certifies that a photocopy of an original document was made that is neither a public record nor publicly recordable. The notary must have access to a copy machine and cannot use a photocopy provided by the requestor.

 

Examples of publicly recordable documents not able to be copy certified by an Arizona notary public are:

 Marriage Records  Birth Certificates 

 Death Certificates  Divorce Records

 Court Records  Real Estate Deeds

 

Translations

A notarized translation is a legal process to seal the authenticity of a certified translated document. It prevents any form of fraud or falsification of documents as it is legally binding contracts that is stamped by a notary public in order to secure its authenticity and discourage any forgery. Hence, the process is frequently referred to as an official fraud-deterrent procedure.

The entire notarization process involves 3 steps, examining, certifying, and record keeping. These 3 critical steps are being handled by a certified Notary Public. Hence, notarization procedure is most often called a notarial act.

Notary Signing Agent

A Notary signing agent is a Notary who is specially trained to handle and notarize loan documents. For lenders, Notary signing agents are the critical final link to complete the loan. A Notary signing agent is hired as an independent contractor to ensure that real estate loan documents are executed by the borrower, notarized, and returned for processing on time. Completing this critical part of the loan process enables the loan to be funded.
